TURKESTAN: LICENSES AND CONTRACTS OF 11 SUBSOIL USERS HAVE BEEN SUSPENDED FOR VIOLATIONS

Licenses and contracts of 11 subsoil users who have not fulfilled their obligations have been prematurely suspended in the Turkestan region. In addition, proposals have been sent to the regional specialized environmental prosecutor's office on early termination of contracts with 38 subsoil users who have not fulfilled their obligations in full. These works are under the strict control of the akim of the region Darkhan Satybaldy.
— It is necessary to apply strict measures to companies that do not comply with the law when using subsurface resources and quarry deposits. Law enforcement agencies should be active. The heads of the relevant departments, as well as the mayors of districts and cities, have been instructed to strengthen work in this direction," Darkhan Satybaldy noted.
At the meeting, the head of the regional department of Entrepreneurship and Industry Nurzhigit Mirzakhmetov reported on the work of the department. According to him, licenses and contracts of subsoil users who illegally operated in the water protection zones of large rivers and lakes of the region, as well as near settlements, were suspended. In particular, work is underway to suspend the activities of fields around the strategically important Bu Gaz kondyrgysy kurylysy (construction of a gas turbine) in the Sairam district, Karamurt rural district, in accordance with the legislation.
The Mayor instructed the responsible authorities and heads of departments to promptly take measures against subsoil users who violated the law, as well as oblige them to restore the land. He stressed that it is necessary to take appropriate measures against illegal mining and strengthen joint raids by mobile groups and internal affairs agencies to prevent violations.
In 2023, social and economic payments in the amount of 1,996.7 million tenge were received from subsoil users. The plan for 2023 is 2.2 billion tenge, of which 897.1 million tenge has already been received, and it will be fully implemented.
In addition, there is constant monitoring of compliance with the legislation by subsoil users. As a result, 62 violations were detected in the fields. Of these, 17 subsurface users reimbursed the damage voluntarily. In respect of four users, the department sent statements of claim to the court, and in respect of 41 users, the documents were transferred to the regional Department of Land Resources.
At the meeting, Acting head of the regional Police Department Baglanbek Aitbayev reported on measures to prevent illegal use of mineral resources. Since the beginning of the year, 204 cases of illegal use of mineral resources have been identified. Documents on 200 cases were sent to the Department of Ecology for prosecution under article 139 of the Administrative Code (violation of the right of state ownership of the subsoil). The Department of Ecology considered 91 administrative cases, imposing fines totaling 2 million 234 thousand 239 tenge, of which 2 million 52 thousand 719 tenge were recovered. Two administrative cases have been brought to court for repeated violations, and 107 administrative cases are currently being considered, most of which are related to the Saurinsky, Sayramsky and Kazygurt districts. Four cases of independent use of subsurface resources have been identified and are being investigated. There are also 178 trucks and 43 pieces of equipment in a special parking lot.
An algorithm for interaction with government agencies has been developed to resolve issues related to subsurface use and transfer criminal cases to court. The work on combating illegal users of mineral resources has been strengthened.
To date, 191 subsurface users have been registered in the Turkestan region, extracting widespread minerals on the basis of 80 contracts and 111 licenses.
