Constitutional Court: Establishing time limits for filing a lawsuit regarding an administrative act does not hinder the exercise of the right to judicial protection

The Constitutional Court received a petition requesting a review of the constitutionality of the first part of Article 136 of the Administrative Procedure and Process Code (APPC), which sets a time limit for filing a lawsuit in court.
The petitioner believes that the contested provision restricts their right to judicial protection.
The Constitutional Court pointed out to the petitioner that setting time limits for filing a lawsuit is part of the judicial protection mechanism available to citizens and does not hinder the exercise of this right under the APPC. The petitioner, as noted in their own submission, exercised their right to judicial protection.
Thus, following a preliminary review, the petitioner’s arguments were deemed insufficient to warrant a constitutional examination of the contested provision.
