The public service of the Republic of Kazakhstan plays a special role in the life of society. It means ensuring the life of society and satisfying public interests in the best and most efficient way.

Civil servants should strive to follow public policy in their work and consistently implement it, maintain and strengthen public trust in public service, the state and its institutions. has the right to determine the rules for entering and holding public service, including the requirements for candidates and relevant restrictions.

The mentioned issues may be related to the need to ensure the effectiveness of the state apparatus, the only source of state power - public trust, and the prevention of abuse of the given powers.

In this regard, on January 10, 2025, Article 16 of the Law "On Public Service of the Republic of Kazakhstan" was declared inconsistent with the Constitution by the Head of State on January 10, 2025. a number of legislative changes have been adopted.

According to the above-mentioned changes, the following time limits will be provided for citizens to enter public service:

1 year - for persons dismissed for non-observance of the restrictions or standards of service ethics provided by the laws of the Republic of Kazakhstan;

2 years - for persons dismissed for disciplinary
misconduct that tarnishes public service (lifetime restriction in previous legislation provided for);

3 years - to persons who have been administratively
punished for committing a corruption offense before entering public service or who have committed criminal misconduct;

5 years - to persons who have been convicted by a court for committing less serious crimes or who have been released from criminal responsibility on grounds that do not excuse them (on the mentioned issue previously provided for a period of 3 years).

8 years - persons who have been convicted by a court for committing crimes of medium severity or who have been released from criminal responsibility on the grounds of inexcusable grounds are subject to restrictions on entering public service (previously provided for a period of 3 years).

and state security, property, business interests in commercial and other organizations, in the field of economic activity and other crimes of moderate severity, or citizens who have been or have been released from criminal liability on the grounds of non-excuseable grounds, as well as corruption, serious and extremely serious, as well as persons who have committed crimes within a criminal group
