The Constitutional Court to Review Provision Barring Former Offenders from Law Enforcement Service

A session of the Constitutional Court was held to consider a citizen’s petition regarding the constitutionality of subparagraph 9), paragraph 2, Article 6 of the Law “On Law Enforcement Service,” which prohibits individuals found guilty of certain violations from being admitted to law enforcement agencies.
Applicant’s Position:
The applicant argues that the challenged provision is disproportionate in its legal consequences compared to other individuals who are allowed to rejoin law enforcement agencies despite having been held accountable for specific types of violations committed within three years prior to reappointment.
Background of the Petition:
The petitioner, a former law enforcement officer, was found guilty of an administrative offense for driving under the influence. This resulted in his dismissal on negative grounds and a restriction on his reentry into law enforcement service.
Participants in the Session:
The petitioner and his attorney, representatives of both Chambers of Parliament, the Prosecutor General’s Office, the Financial Monitoring Agency, the Anti-Corruption Agency, the Ministries of Internal Affairs and Justice, the National Center for Human Rights, and the Institute of Legislation and Legal Information.
