International Court of Arbitration of the International Chamber of Commerce in the city of Paris made a decision in favor of the Republic of Kazakhstan

On May 15, 2020, a joint venture consisting of the companies Todini Costruzioni Generali S.p.A., WeBuild S.p.A., and Kazakhdorstroy LLP acting as part of the Joint Venture “Todini Impregilo Kazakhdorstroy” (hereinafter referred to as the “Claimants”) filed a Request for the International Court of Arbitration of the International Chamber of Commerce (ICC) against the Committee of Highways of the Ministry of Industry and Infrastructural Development of the Republic of Kazakhstan (hereinafter referred to as the “Committee”) arising from disputes in connection with the Almaty-Khorgos Road Project in the Republic of Kazakhstan.
During the Merits phase the Claimants had asserted claims against the Committee totaling about US$ 50 million, including for prolongation costs, customs duties and taxes, inflation of tenge, changes in costs, backfilling of culverts, aborted construction of a road maintenance depot, and financing charges.
On April 14, 2025, a Tribunal constituted under the ICC International Court of Arbitration in the city of Paris made its Final Award in favor of the Committee. The Tribunal rejected all asserted claims entirely.
The Tribunal also accepted the Committee’s counterclaim ordering the Claimants to repay as overpayment all prolongation costs paid to Claimants during the project. It also found that the Committee is entitled, as the prevailing party, to recover the full amount of its legal and arbitration costs.
The representation and protection of the Committee interests in this case is provided by the Ministry of Justice of the Republic of Kazakhstan. The law firm “Curtis, Mallet-Prevost, Colt & Mosle LLP” was engaged as Consultant.
