The court declared the transfer of the plot of land to private ownership illegal and returned it to the state.
The plot of land was planned to be acquired for state needs as part of the reconstruction of the oil refinery. However, an unplanned inspection of the Department of Land Resources Management of Shymkent City of the Land Management Committee of the RK Land Management Center found that the plot of land was transferred to private ownership in violation of Article 48 of the Land Code of the RK. According to this article, the transfer of land plots by the state should be carried out only on a competitive basis, that is, through auctions and contests.
In this case, the land plot was given without passing the necessary procedures, which is a direct violation of the legislation.
The department's demand was satisfied by the specialized interdistrict economic court of Shymkent. The decision entered into legal force.
Thanks to the temporarily adopted measures, it was possible not only to restore legality, but also to prevent unreasonable expenses from the state budget in the amount of 164.2 million tenge.
