Constitutional Court: practicing directly in Kazakhstan after completing Bolashak training is a condition of a civil contract under the law

A citizen appealed to the Constitutional Court to verify the constitutionality of subparagraph 5) of paragraph 24 of the Rules for the selection of applicants for the award of international scholarship “Bolashak”, approved by the Government of the Republic of Kazakhstan on June 11, 2008 № 573.
The applicant does not agree with the requirement of the Rules on the work of graduates of the program “Bolashak” in the territory of Kazakhstan after completion of training. As an argument, the applicant cited the Labor Code, which provides for the format of remote labor activity. Consequently, in the applicant's opinion, actual presence in Kazakhstan for the purpose of work placement was not required.
The Constitutional Court stated that training under the Bolashak program is carried out on the basis of a civil contract concluded prior to the commencement of studies by mutual agreement of the parties. Such an agreement presupposes prior voluntary acceptance by the parties of their obligations, including the obligation to work directly on the territory of the Republic of Kazakhstan after training. This condition is stipulated not only by the Rules, but also follows from the Law on Education.
Thus, there are no grounds to verify the compliance of the norm of the Rules on the workout with the Constitution.
