Berik ASYLOV: Legal responsibility is the pillar of justice

Strategic orientation based on the principle of "law and order" has become the core of the state policy of the country and determines the main direction of social development. This is a system that guarantees fair protection of human rights and freedom, and aims to create social order. Prosecutor General Berik ASYLOV spoke extensively about the steps in the implementation of this concept, the role of the prosecutor's office and the importance of legal culture. padding-80">
- Berik Nogaiuli, do you think that the concept of "law and order" is really a new system for increasing people's trust? What is the role of the prosecutor's office in ensuring not only legal, but also social justice?
- "Law and order" - the ideological platform of Just Kazakhstan. This is a conclusion that reveals the essence of our Constitution. Our constitution recognizes the highest value of human life, rights and freedoms. Head of State Kassym-Jomart Tokayev emphasized the deep meaning of the word "Law is the art of virtue and justice" and emphasized that "the law is necessary to protect the rights and freedoms of citizens and ensure order in society." In my opinion, this ideological statement means the need to preserve public ideals, especially cultural, moral, family, spiritual and religious values, as well as constitutional guarantees such as freedom of work, healthcare, education, property and entrepreneurship. At the same time, care for nature and the environment should also be in this line. Therefore, "Law and order" are not just legal concepts, but life orientations that lead to the stability and security of society, prosperity of the country.
In order to promote these principles, the Government approved a special concept for the next 5 years this year. Its main goal is to increase the legal awareness of citizens, their active participation in maintaining the legal order, and the formation of public immunity against violations of the law. Prosecutor's office is the main participant and coordinator of this work. We have been comprehensively implementing the principles of law and order. In this direction, specific measures are being taken with the coordination of the Presidential Administration together with the interested bodies and organizations. All performed activities are aimed at strengthening the rule of law, implementation of social responsibility on the part of the state. The main thing is to protect the constitutional rights of citizens, honest business and the interests of the state.
There are good examples of restoring the violated rights of citizens, especially children. Already this year, with our acts, 22 billion tenge were paid for the benefit of 28,000 children in terms of alimony alone. 366 graduates of the orphanage and 108 socially vulnerable people were provided with housing. 2.2 billion tenge in salary arrears were collected for 2.3 thousand employees.
More than 1,300 foreign investors were assisted. Their contribution to the country's economy is 17 trillion tenge. Currently, there are more than a thousand investment projects under the control of prosecutors. In this regard, the priority is to support domestic entrepreneurs. Timely assistance to entrepreneurs created an opportunity to add new industries, create 14,000 new jobs and save 4,500 jobs.
333 objects, including schools, hospitals, and sports complexes, are being built at the expense of illegal assets returned to the state by the prosecutor's office. This is a real proof of how the funds work for the benefit of society.
Also, we openly condemn the narcissistic attitude. That is, some citizens consciously refuse to work and have unreasonable hopes for social assistance - a phenomenon contrary to justice. The law provides opportunities, but it also requires the fulfillment of duties, including maintaining law and order and respecting the interests of other people. The state creates conditions for self-development, entrepreneurship, education, and professional growth for citizens. And alcoholism violates social justice, creates a false life orientation and limits the opportunities of truly needy citizens.
Responsibility is not only making demands, but also being ready to contribute to a common cause. The path to a stable and just future will be opened only when every citizen feels that he is personally responsible for his development, family, work, and compliance with the law. In general, we seek to shape the law as a symbol of justice, not an instrument of fear or oppression. If a person accepts the law as his fortress, a part of his being, he will never violate the law.
- It is clear that the creation of a civil society at the level of established legal culture requires systematic measures and ideological work. What is the contribution of the prosecutor's office to the works in this direction?
- There is a saying "grass does not grow on barren land". This parable is directly related to the field of legal consciousness. If there is no concept of what is right and what is wrong in society, then people cannot distinguish between black and white. Therefore, the formation of respect for the law is an integral part of the state policy and national idea. Any successful state relies on a certain system of values, which determines the rules of education and behavior. Ideology helps to form a unified vision of justice, order and development in society. A sense of respect for the law is formed, the mutual responsibility of the state and society, and the ideological unity of citizens are strengthened.
Today, a moral and ethical foundation is being created in our country aimed at forming the image of a conscious, responsible, honest, qualified citizen. This is the main ideal of the "Honest Citizen" concept. We all know that such a foundation is laid in early childhood, formed in the family, at school, and takes root throughout the entire conscious life of a person. The most important thing is to lay the foundations for the formation of a new personality of young people who adhere to law and order from an early age. Taking this into account, the prosecutor's office pays special attention to raising the legal awareness of pupils and students. For example, "Start discipline with yourself!" within the scope of the action, we held hundreds of events in all regions in order to educate the legal culture and to form law-abiding behavior among the younger generation. The head of state supported our initiative to hold "legal hour" in schools with the participation of retired judges and retired law enforcement agencies. For example, in Talgar district, three colleges and 20 schools in grades 7-10 launched a universal legal education project. It is planned to spread this practice widely throughout the country. In order for children to understand the advantages of exemplary behavior, we use various methods: thematic lectures, clubs, theatrical performances are organized. For example, in Astana, a competition of performances entitled "Law and children: error-free future" was held among 100 schoolchildren. In them, children presented important concepts such as rights, responsibility, choice on stage. "Young Assistant Prosecutor" clubs were opened in 170 schools of Almaty region.
Furthermore, on our initiative, the Tele2/Altel company in Almaty issued the first "SIM-Kids" children's card, which protects children from illegal content, including suicide, drug, and abuse propaganda. It gives parents the ability to determine the location of the child, listen to what is happening around him, see correspondence in messengers, control which application he spends time on and contact him when the device is in silent mode. In the near future, the SIM card will be available to the public.
I would like to mention that young citizens are also actively involved in the formation of law-abiding behavior. For example, in Abay region, he held meetings with students, future lawyers, 5th-10th graders and held preventive talks on the topics of bullying, drug addiction and extortion. Materials for the meeting were presented by the prosecutor's office on the basis of its investigations. Currently, we have signed memorandums with 40 higher educational institutions of the country. In Shymkent "Choose! Change! Be creative!” Republican forum was held. There, the importance of choosing the right future profession was explained to schoolchildren, issues of prevention of offenses, organization of safe and useful summer vacation were raised. I believe that every such step and idea contributes to the deep absorption of the ideology of "Law and Order" in the public mind, especially among the younger generation. If you focus on achievements in this area.
- Coordination measures allow to comprehensively solve problems of stabilization of crime prevention. As I said earlier, the crime rate has steadily decreased in recent years. Violent crimes in particular have significantly decreased, which means that the safety of life in the country has increased. This is the result of systematic and comprehensive work of all state bodies, citizens and organizations. Foreign experts also give a positive assessment of this. According to the 2024 Global Peace Index, Kazakhstan was recognized as the most peaceful country in the Eurasian region. This means that we are on the right track. Today, however, the whole world, including Kazakhstan, is facing the global growth of cybercrime.
We regularly discuss issues of combating new types of crime in coordination councils, develop approaches and methods to combat them, and ensure coordinated action not only with power structures, but with other interested bodies and foreign partners. Their effect on changing the situation is noticeable. For example, at present, we have moved to widespread use of IT technologies with predictive and analytical functions, and have started to introduce advanced international practice. A number of innovative methods were tested in the fight against the drug business. We are identifying drug laboratories by analyzing air flows and sewage samples with the help of a gas chromatograph. It's no secret that online drug stores use Telegram channels, QR codes, and online transfers. Therefore, first of all, we prevent their financial flow. Already this year, more than 20,000 "dropper" accounts and 2.4 billion tenge of drug income have been blocked.
We are studying foreign experience in order to strengthen control over precursors. Starting this year, based on the experience of the USA and Lithuania, a pilot Targeting Center has started working on the basis of our Committee on Legal Statistics to collect and analyze information on the transport and internal circulation of precursors. This allows us to fully control the circulation of chemical precursors, we can see who is using them and how.
New methods are also being introduced in the fight against cyber fraud. In particular, we are fighting SIP-telephony, which allows anonymous calls from abroad, and destroying SIM-boxes. A methodology has been developed to expose cyber groups and identify and bring to criminal responsibility people who provide bank cards to fraudsters - "droppers", as well as employees of financial organizations, communication operators and CSOs who facilitate fraud. In the next two years, with the coordination of the prosecutor's office, the activities of 10 international contact centers that were deceiving our citizens were suspended.
At the same time, together with state bodies, we are strengthening the protection of victims at the legislative level and forming investigative practices. In accordance with the amendments made to the Law "On Banks and Banking Activities" adopted last year, the collection of debts of more than 3.4 billion tenge of more than 2.5 thousand injured persons was stopped during the investigation. In addition, additional protective measures are being introduced. For example, the information of communication operators is integrated with the National Bank's Anti-Fraud Center, blocking fraudulent transactions and fraudulent calls.
It should be noted that the format of coordination councils is not stable, it changes according to the demands of society and the legal activity of citizens. We support and encourage our citizens to take a conscious and responsible approach to the prevention of such anti-social phenomena. Recently, forums on promoting the ideology of "Law and Order" were held in all regions within the framework of Coordination Councils with the participation of the public, business community and youth. At these events, students presented a number of interesting projects. For example, students of Shymkent offered to create systems that provide assistance to people with hearing and vision impairments and ensure safe movement. And the students of West Kazakhstan and Zhambyl regions presented projects to prevent conflicts and bullying in schools. We are always interested in supporting such initiatives of young people and will continue to work in this direction.
- We understand from your words that the role of modern technologies in the fight against crime is huge. How are digital technologies used in law and order enforcement?
- Indeed, taking into account the current challenges, we are looking for innovative solutions to detect and suppress criminal offenses, including hidden types, and to quickly respond to new criminal threats. We have unique information and analysis systems. The information system of BKARK has been launched. This helps in identifying and apprehending wanted persons. The system finds "digital footprints" of people through the databases of government agencies and CCTV cameras. A wanted person is arrested the moment he appears on camera or applies for public service. Since the beginning of the year, the number of wanted persons has decreased by 2.5 thousand.
We use drones connected to the BKARK system to detect crimes on the streets and open spaces. For example, with the help of a drone, the prosecutor's office of Abay region found out the fact of illegal underground mining. The perpetrators of the violations were brought to justice.
Artificial intelligence elements are used in the criminal-executive system based on the BKARK. Monitoring of probationers using video cameras is underway. If the monitored person violates the restrictions on behavior and being in a public place, the system will signal. This allows timely response to the violation. Also, on our initiative, information about people on probation is integrated with the "Digital Family Card" platform of the Ministry of Labor and Social Protection of the Population. The program determines which government agency should provide which assistance. More than 200 services were provided in this format. The project has been launched in several regions.
In general, our experience of introducing digital technologies is causing great interest among foreign colleagues.
- What is the first priority in the implementation of the concept of "law and order"? Is it the legal awareness of citizens or the effectiveness of institutions and laws?
- I want to emphasize that this concept is the way to the future, where the power of the state is measured not by the number of sentences, but by the trust of the people. And no law will work effectively if public consciousness does not support it. That's why you can't separate them from each other. Observing the law is not a fear of punishment, but an inner belief of each person. When everyone respects the law, a sense of justice and security emerges in society. Everyone should respond appropriately to any violation of the law and show zero tolerance. I would like to say once again that being a citizen is not only a right, but also a duty.
The law is common to everyone, and legal consciousness should be a natural trait of every person. Yes, this path is not easy. However, a lot of work has been done. The constitutional reform strengthened the institutions for the protection of citizens' rights. The prosecutor's office is on the way to change not only in the field of law enforcement, but also in interaction with the public. We are strengthening feedback and focusing on crime prevention rather than just enforcement. We are extremely grateful to the people who contributed to this cause. This shows that the society is maturing.
In general, every citizen, every organization and every state body should be involved in the implementation of the concept of "Law and order". Each step should be seen as an investment in building a rule-of-law state with strong institutions and responsible citizens. Therefore, there is still a lot to be done. The most important thing here is the unity of actions, common vision and mutual responsibility. We will continue this work persistently and systematically.
