We would like to inform you that, in accordance with subparagraph 13) of Article 616 of the Code of the Republic of Kazakhstan "On Taxes and Other Mandatory Payments to the Budget" (the Tax Code), the following persons are exempt from paying state duty in courts:

• veterans of the Great Patriotic War;

• persons equated in benefits to Great Patriotic War veterans;

• veterans of military operations on the territories of other states;

• individuals awarded orders and medals of the former USSR for selfless labor and exemplary military service on the home front during the years of the Great Patriotic War;

• individuals who worked (served) for at least six months from June 22, 1941, to May 9, 1945, and were not awarded orders or medals of the former USSR for selfless labor and exemplary military service on the home front during the Great Patriotic War;

• persons with disabilities;

• as well as one parent of a person with a childhood disability or a child with a disability — for all cases and documents.

In this regard, the above-mentioned individuals are not required to pay state duty to the budget when filing a claim with judicial authorities.

We remind you that the period for refunding the excess amount of state duty paid is three years from the date such amount was paid to the budget (paragraph 6 of Article 108 of the Tax Code).
