The new principles and norms in the new text of the Constitution are innovations that can serve as an example and a guideline for other countries. This was stated by State Counselor Yerlan Karin at the ninth meeting of the Constitutional Reform Commission.
According to him, some citizens are also posting comments on social media saying, "Before we get into trouble, we should just copy another country's Constitution."
"Recently, due to the development and prosperity of completely new directions, such as digitization and digital technology, many states are considering introducing relevant norms into the constitutional and legal system. Our country is one of the first to introduce the norm of digital data protection into the Constitution. That is, the new principles and norms in the new text can serve as an example and a guideline for other countries," noted Erlan Karin.
The State Counselor noted that paragraphs 1 and 2 of Article 21 of the Constitution guarantee the right to privacy, the right to personal and family secrecy, and the right to protection of personal data from unlawful collection, processing, and use.
"That is, we are one of the first countries to enshrine in the Constitution the protection of personal data in the digital space as a new measure of human rights protection. This is another proof of the future-oriented nature of the new Constitution," he emphasized.
According to Erlan Karin, a major innovation in the region's legal system is the constitutionalization of the famous Miranda rule. This change will increase the legal protection of citizens and impose new requirements on the activities of law enforcement agencies.
In addition, the introduction of new political institutions is a political innovation not only for the Central Asian region, but also for the wider space around us. Erlan Karin noted that in this regard, the introduction of a unicameral parliament, the institution of the vice president, the high consultative body of the "People's Council", and the Constitutional Court are a major political innovation compared to the political systems of many countries.
"The initiative of the President to implement constitutional changes only through a nationwide referendum is also one of the important decisions for our region. The establishment of a single term for the activities of many officials is also an important innovation in the draft Constitution," the State Counselor explained.
Also, as the State Counselor noted, the new Constitution includes new requirements and values emerging in social development, such as protecting the rights of women and children, protecting the environment, volunteering, and responsibility to parents. This also indicates that the new Constitution corresponds to the current state of society and the level of development.
"A number of political and institutional innovations in the new Constitution are rare in regional and global constitutional practice. In short, copying and repeating the Constitutions of other countries is not our path. On the contrary, in the future, Kazakhstan, through the new Constitution, will become a model and a guide for other countries," concluded Erlan Karin.
