During the expert dialogue on the topic "New Constitution: a new architecture of trust and development" held in Astana, the Minister of Justice of the Republic of Kazakhstan, Yerlan Sarsembayev, answered a question about the relationship between national and international law in the draft of the new Constitution.

According to the minister, Article 1 of the Constitution clearly states that the Republic of Kazakhstan is a state governed by the rule of law. According to Article 5, the current law includes the norms of the Constitution, laws in accordance with it, normative decrees of the Constitutional and Supreme Courts, other normative legal acts, and international treaty obligations.

It was also noted that the Constitution has the highest legal force and is directly applicable throughout the territory of the republic as a very important principle. This is the main norm that determines the solid foundation of the national legal system.

The Minister also focused on Article 10, stating that Kazakhstan respects the principles and norms of international law, pursues a policy of peace and cooperation, and firmly adheres to the principles of non-interference in the internal affairs of other states and the peaceful resolution of international disputes.

Thus, the new draft Constitution presents a balanced legal model based on respect for international law while preserving the supremacy of national law. This is an important step that will strengthen the principles of the rule of law and create a reliable foundation for the country's sustainable development.
