WHICH ADMINISTRATIVE OFFENSES ARE CONSIDERED CORRUPTION-RELATED?

The Code of the Republic of Kazakhstan on Administrative Offenses classifies the following acts as administrative corruption offenses:

Provision of illegal material remuneration, gifts, benefits, or services by individuals to persons authorized to perform state functions or persons equated to them, provided these actions do not constitute a criminal offense (Article 676) — entails a fine of 200 MCI (Monthly Calculation Index).

Receipt of illegal material remuneration, gifts, benefits, or services by a person authorized to perform state functions (or a person equated to them), either personally or through an intermediary, for actions or omissions within their official powers, provided these actions do not constitute a criminal offense (Article 677) — entails a fine of 600 MCI.

Provision of illegal material remuneration, gifts, benefits, or services by legal entities to persons authorized to perform state functions or persons equated to them (Article 678) — entails a fine of 750 MCI.

The same actions committed repeatedly within a year after the imposition of an administrative penalty — entail a fine of 1500 MCI.

Engagement in entrepreneurial activity by state bodies or local self-government bodies beyond their legislatively assigned functions, or the acceptance of material benefits and advantages beyond established funding sources (Article 679) — entails a fine on the heads of these organizations in the amount of 600 MCI.

Failure by heads, executive secretaries, or other authorized officials to take measures within their powers against subordinates guilty of committing corruption offenses, or failure to provide relevant information to the state revenue authorities at the place of residence of the guilty persons (Article 680) — entails a fine of 100 MCI.

Hiring persons who have previously committed a corruption crime by heads of state bodies, institutions, enterprises, national companies, or national development institutes (Article 681) — entails a fine of 100 MCI.
