One of the primary goals of technical regulation is to prevent actions that mislead consumers regarding the safety and quality of products.

Before selling products, manufacturers, importers, and sellers are obligated to ensure that the products have undergone testing and to confirm their safety through certification or a declaration of conformity.

It is important for consumers to know that compliance with technical regulations is a direct obligation of manufacturers, importers, and sellers. The technical regulations themselves, considering the degree of risk of harm, establish the minimum necessary requirements ensuring: biological, mechanical, fire, thermal, chemical, electrical, radiation safety, electromagnetic compatibility in terms of ensuring the safe operation of instruments and equipment; radiation safety, explosion safety, safety of technical devices used at hazardous production facilities, etc.

The activity of the Committee for Technical Regulation and Metrology of the Ministry of Trade and Integration of the Republic of Kazakhstan is aimed at preventing offenses and preventing non-conforming products from entering the market.

In this regard, preventive control without visitation is conducted on an ongoing basis, the goals of which are the timely suppression and prevention of violations, granting the supervised entity the right to independently rectify violations, and reducing the administrative burden on it.

On this issue, study, analysis, and comparison of information obtained from various sources, including, of course, from mass media and other open sources, as well as appeals from individuals and legal entities, are carried out.

One of the preventive tools is a test purchase, which is carried out by territorial subdivisions in accordance with the Entrepreneurial Code of the Republic of Kazakhstan and the legislation in the field of technical regulation.

According to information from Deputy Chairman of the Committee Bauyrzhan Kasymov, in 2025, 3163 forms of state control were conducted, with violations identified in 978 cases (31%). Fines totaling 26,749 million tenge were imposed. Testing of 197 samples was conducted, resulting in 41 resolutions on the application of operational response measures.

This year, as part of test purchases in the Karaganda region, 4 coal samples were purchased and sent for testing; in the Kostanay region, 4 cable product samples and 2 fuel and lubricant samples were purchased.

Test purchases are aimed at testing vehicles, construction materials, fuels and lubricants, coal, electrical devices operating at alternating current voltages up to 1000 V (or direct current up to 1500 V), designed for receiving, distributing electricity, managing loads, and protecting networks.

The Committee reminds that consumers, if they have compelling grounds and supporting evidence to prevent and/or eliminate an immediate threat to human life and health, the environment, and the legitimate interests of individuals, legal entities, and the state, have the right to file an appeal regarding violations of technical regulation requirements.

According to legislation in the field of technical regulation, a necessary condition for placing products on the market for which technical regulations are in effect is their conformity with the requirements established by the technical regulations, confirmed in the prescribed manner.

Furthermore, it is prohibited to release into circulation products for which technical regulations are in effect that have not undergone conformity assessment, as well as without having conformity assessment documents or in the absence of information about the availability of such documents in the technical regulation register or the unified registers of issued or accepted conformity assessment documents of the Eurasian Economic Union.

Administrative liability is provided for releasing into circulation products that do not comply with the requirements established by technical regulations, as well as with the information specified in conformity assessment documents, and for releasing into circulation products for which technical regulations are in effect that have not undergone conformity assessment, or without having conformity assessment documents, or in the absence of information about the availability of such documents in the technical regulation register or the unified registers of issued or accepted conformity assessment documents of the Eurasian Economic Union.

For persons who have committed an offense, a fine is provided: for individuals in the amount of ninety, for officials, small business entities, or non-profit organizations – in the amount of one hundred ninety-five, for medium-sized business entities – in the amount of three hundred ten, for large business entities – in the amount of six hundred monthly calculation indices.
