Working for the state is not just about authority; it is about strict commitment to integrity. Article 12 of the Law of the Republic of Kazakhstan "On Combating Corruption" establishes clear boundaries to prevent conflicts of interest.

Who is subject to these rules?

Persons holding responsible public offices, individuals authorized to perform state functions, and those equivalent to them.

  1. Incompatible Activities: Prohibited from engaging in any activity that conflicts with the performance of state functions.
  2. Nepotism Ban: Close relatives, spouses, and in-laws are not allowed to work in direct subordinate positions to one another.
  3. Information Misuse: Prohibited from using non-public official information for personal gain or advantages.
  4. No Gifts: Acceptance of material rewards, gifts, or services for actions (or inaction) within their official capacity is strictly forbidden.
  5. Foreign Bank Accounts: Prohibited from opening or holding accounts in foreign banks outside of Kazakhstan, as well as keeping cash or valuables in foreign banks.
  6. Gambling: A strict ban on participating in gambling and betting (both in physical casinos and online).

  • Dismissal โ€” if these restrictions are violated or if the official refuses to comply.

The law provides a specific "honest behavior" algorithm:

  • Money: Funds received without the official's knowledge must be transferred to the national budget within 2 weeks of discovery.
  • Gifts: Must be handed over to the authorized state property management body within 7 calendar days.
  • Services: If a service was rendered, its value must be paid into the national budget within 7 days.

Note: A public servant has the right to buy back a gift they surrendered from the state at its appraised market value.
