Algorithm for transferring confiscated property to the balance sheets of law enforcement and special state agencies (hereinafter referred to as LSSA)
The SPA or MIO publishes a notice on the web portal of the state property register (hereinafter referred to as the web portal) regarding confiscated property offered for transfer to the balance of LSSA, no less than 15 calendar days before the date of opening the applications.
LSSAs, if there is a need for this property, submit via the
web portal applications specifying the name of the property, the required quantity, justification for the necessity of its transfer, and attach an electronic (scanned) copy of the conclusion from the authorized body of the relevant industry, which indicates the criteria for the economic feasibility of transferring the property:
- need within the limits of natural norms for property entitlement;
- intended use of the property and the presence of production necessity;
- financial provision for the maintenance and operation of the property.
Upon the date and time of the application deadline, the web portal automatically opens them.
The applications and documents attached to them are reviewed by the commission of the SPA or MIO for compliance with the above-mentioned criteria, and based on them, the commission of the SPA or MIO makes a decision, formalized in a protocol.
If there are several applications, priority is given to the LSSA that submitted the application first, provided it meets the above criteria. If after satisfying its needs there is surplus property, it is offered to subsequent applicants.
In case of a positive decision by the commission, within 15 working days, the SPA/SPA or MIO makes a decision on assigning/transferring the property to the balance of the LSSA, after which within 10 calendar days it is transferred via an acceptance-transfer act.
In case LSSAs do not submit applications or if the transfer of property to state ownership is economically unfeasible, the property is put up for auction.
