When carrying out foreign economic activity, each product transported across the customs border is subject to mandatory classification in accordance with the Commodity Nomenclature of Foreign Economic Activity (HS EAEU).

HS is a single classifier of goods that is used in the territory of the countries of the Eurasian Economic Union. The system allows you to identify goods, determine the amount of customs payments and taxes, as well as establish tariff and non-tariff regulatory measures.

The classification of a product is based on its main characteristics.:
🔹 assignments and functions performed;
, manufacturing material;
🔹 composition and technical characteristics;
🔹 the degree of processing and readiness for use.

Each product is assigned a unique ten-digit code. It is this code that is used in the customs declaration and is the basis for determining:
✔️ customs duty rates;
✔️ Value added tax;
✔️ excise taxes;
✔️ permits;
✔️ prohibitions and restrictions;
✔️ maintaining customs statistics.

The structure of the HS code is based on the principle of product detail:
the first two digits indicate the product group;
The first four digits represent the product position.;
The first six digits are a subheading;
All ten digits define a specific type of product.

The correct definition of the HS code is the responsibility of the declarant. At the same time, it is necessary to take into account the Basic Rules of interpretation of HS, notes to sections and groups, as well as explanations and clarifications of authorized bodies.

It should be remembered that incorrect classification of goods can lead to serious consequences:
additional customs duties and taxes;
, bringing to administrative responsibility;
, the imposition of fines;
, delayed release of goods;
additional checks by the customs authorities.

Therefore, before importing or exporting products, it is important to carefully study the characteristics of the product, request technical documentation from the manufacturer and make sure that the selected HS code is correct.

Proper classification of goods makes it possible to minimize risks, avoid financial losses and ensure the smooth passage of customs procedures.
