Persons holding a responsible public position, persons authorized to perform public functions, officials, members of territorial election commissions, employees of the National Bank of the Republic of Kazakhstan and its departments, employees of the authorized organization responsible for investigating aviation accidents and incidents, the authorized organization in the field of civil aviation, employees of the authorized body for regulation, control and supervision of the financial market and financial organizations, as well as persons equated to persons authorized to perform public functions who carry out activities in national management holdings, national holdings, national companies, national and regional development institutions, and their subsidiaries, are prohibited from:

participating in the management of a commercial or non-commercial organization, except where such participation constitutes part of their official duties in accordance with the legislation of the Republic of Kazakhstan;

engaging in entrepreneurial activities;

engaging in other paid activities, except for teaching, scientific, creative activities, and military service in the reserve;

acquiring securities, except for the acquisition and/or sale, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, of units of open-ended and interval investment funds, bonds, and shares of commercial organizations (ordinary shares in an amount not exceeding five percent of the total number of voting shares of such organizations).

Contract military personnel serving in positions corresponding to a medical military occupational specialty are entitled to engage in paid medical activities, provided that such activities do not interfere with the performance of their military duties.

The persons referred to above are required, within thirty calendar days from the date of assuming office, to transfer into trust management, for the duration of the performance of their respective functions and in accordance with the procedure established by the legislation of the Republic of Kazakhstan, any property owned by them under a right of ownership or another proprietary right, the use of which generates income, except for money, bonds, units of open-ended and interval investment funds, shares of commercial organizations (ordinary shares in an amount not exceeding five percent of the total number of voting shares of such organizations), digital assets lawfully owned by such persons, as well as property transferred for lease (rental).

Within the same period, they are required to submit to the human resources department (personnel service) at their place of employment a notarized copy of the property trust management agreement.

The persons referred to above are entitled to lease (rent out) residential premises owned by them and receive income from such leasing, as well as to receive income from property transferred into trust management and from other lawful sources.

Failure by the persons referred to above to comply with the obligations established herein shall constitute grounds for termination of their public service or other relevant activities.
