Supreme Court Aligns Procedure for Reviewing Civil Cases with the Constitutional Court’s Legal Position
08.10.2026 21:54:51 476The Supreme Court of the Republic of Kazakhstan has amended Regulatory Resolution No. 12 of December 8, 2017, concerning the review of judicial acts on the grounds of newly discovered or new circumstances.
The amendments were adopted to implement the legal position of the Constitutional Court set out in Regulatory Resolution No. 88-NP of June 12, 2026.
Previously, the Constitutional Court emphasized the need to provide for the possibility of reviewing a judicial act where a final and binding judicial act in another case contradicts the factual grounds of an earlier decision, provided that such circumstances are of substantial significance to the case.
Under the amendments, such a judicial act is recognized as a ground for reviewing the previously adopted judicial act.
This makes it possible to prevent situations in which judicial acts containing conflicting findings on the same material circumstances remain in force, thereby strengthening guarantees of the right to judicial protection.
