The Ministry of Justice held an international seminar on collective rights management

An international seminar on collective rights management, organized with the support of the World Intellectual Property Organization (WIPO), was held in Almaty today. The event brought together international and national experts in the field of intellectual property, representatives of government agencies and international organizations, public organizations and authors.
The seminar was aimed at discussing topical issues and challenges related to the collective management of the rights of authors, performers and other copyright holders. The participants discussed the mechanisms of copyright protection and promotion in the context of globalization and digitalization of the economy.
The seminar was opened by Vice Minister of Justice of the Republic of Kazakhstan Botagoz Zhakselekova, stressing the importance of ensuring the rights of authors and copyright holders to receive fair remuneration for the development of culture and creative industries.
The speakers at the seminar were experts from WIPO Miyuki Monroig, the European Union Galatea Kapellakou, Malaysia Nur Alif Bin Musa, as well as domestic experts in the field of collective rights management, including representatives of organizations for collective rights management (OCM).
The Chairman of the Committee on Intellectual Property Rights of the Ministry of Justice of the Republic of Kazakhstan, Sholpan Abdreeva, presented an overview of the legislation of the Republic of Kazakhstan regulating the collective management of copyright and related rights. In her speech, she emphasized the peculiarities of this institution, and also focused on topical issues such as the multiplicity of payouts, the need to increase transparency and enhance the effectiveness of their activities.
Miyuki Monroig, Advisor to the Copyright Management Department at WIPO, highlighted the various models of collective rights management, as well as the requirements for organizations managing property rights. She spoke in detail about the digital products developed by WIPO, which simplify the processes of distribution and payment of remuneration, making them more transparent and efficient.
Galatea Capellacou, an expert from the European Union and senior intellectual property lawyer, stressed the need to increase transparency and efficiency of the CPA in order to fully ensure the rights of authors. She also drew attention to the EU directives governing the activities of the OCP, and to the standards that help to strengthen trust in these organizations.
Nur Alif Bin Musa, Assistant Director of the Copyright Department of the Intellectual Property Corporation of Malaysia, highlighted the importance of providing users of copyright and related rights with accurate reports for fair remuneration of copyright holders. He also spoke about measures aimed at increasing the transparency of the activities of the OCP, which is one of the key aspects of effective rights management.
Composers Artyk Toksanbai and Alim Zairov touched upon topical issues of protecting the rights of composers. One of the topics they raised was ensuring the rights of authors who create music specifically for films, as well as the need to consolidate existing payoffs to increase their effectiveness.
In her speech, Botagoz Kaldayakova touched upon problems in the field of collective management, highlighting the lack of transparency of organizations' activities, including issues related to holding a general meeting.
Thus, the participants of the meeting stressed the importance of an integrated approach to reforming the system of collective rights management, paying special attention to transparency, efficiency and protection of the interests of all stakeholders.
Special attention was paid to the development of the collective management system in Kazakhstan and the improvement of legislation in the field of intellectual property rights protection. One of the problems in the field of collective management of copyright and related rights is the existence of 15 payouts. The participants discussed the importance of transparency, digitalization in rights management and timely fair distribution and payment of remuneration to authors and copyright holders. The activity of 15 OKUP in Kazakhstan makes it difficult for authors and copyright holders, as well as users, represented by entrepreneurs, to choose. The main task facing the payback is the collection, timely distribution and payment of remuneration to authors and copyright holders. The realization of this task is the key to stimulating authors to create new works and, in general, the development of culture.
This dialogue platform has become an important step towards improving the system of collective management of rights and the development of intellectual property in the region.
