New restrictions and fines on advertising of bookmakers and sweepstakes have come into force in Kazakhstan

The Committee on Regulation of Gambling and Lottery of the Ministry of Tourism and Sports of the Republic of Kazakhstan informs that since September 9, 2024, strict restrictions have been imposed on advertising of bookmakers and sweepstakes in the territory of the Republic of Kazakhstan. In connection with the issues arising from business entities, the agency provides the following clarifications.

🔺Prohibition of advertising
Outdoor advertising: A complete ban on advertising in open spaces, building facades, vehicles and outdoor structures, except for the locations of betting shops or betting shops, inside sports facilities and on athletes' equipment. Logos and trademarks of bookmakers cannot be used in advertising of other businesses.

🔹Mass media: Advertising in cinemas, reference books and general media is prohibited, with the exception of specialized sports channels. General content TV channels such as Khabar and Qazaqstan have the right to advertise bookmakers only during live broadcasts of international sporting events.

🔹Transport: Advertising on vehicles is completely prohibited.

🔺Advertising is allowed
Sports media: It is allowed to advertise bookmakers exclusively to specialized sports TV channels and media outlets completely devoted to sports topics and registered in accordance with the established procedure.

🔹Sports events and equipment: Logos and trademarks of bookmakers can be placed on sports equipment and equipment of athletes.

🔹Exception
Live broadcasts of international sports events: Advertising of bookmakers on general TV channels is allowed only during the period of live broadcasts of international sports competitions. Advertising before and after the broadcast is prohibited.

🔹Names of tournaments and venues: Bookmakers' trademarks may be included in the official names of sports tournaments, venues and projects, subject to compliance with the law.

🔺Penalties for violations
Failure to comply with the requirements of the legislation on advertising of bookmakers or sweepstakes entails administrative fines:

The first violation: individuals — 60 MCI, officials — 80 MCI, small businesses and NGOs — 120 MCI, medium—sized businesses — 170 MCI, large businesses - 400 MCI.

Repeated violations during the year: individuals — 170 MCI, officials — 200 MCI, small businesses and NGOs — 250 MCI, medium—sized businesses — 350 MCI, large businesses - 650 MCI.

🖌️The advertiser, the advertising producer and the advertising distributor are responsible for violating the legislation.

The Ministry of Tourism and Sports of the Republic of Kazakhstan recalls that in case of violations, citizens can file a complaint through the online reception of the Committee. The Agency will take the necessary response measures.
