The metropolitan Department of Control and Quality of the Urban Environment has suppressed the fact of the start of unauthorized construction of the facility, the official website of the Mayor's Office of Astana reports.
Under the coordination of the city Prosecutor's office in the capital, the fact of illegal attraction of citizens' funds without the appropriate permission was revealed.
The developer of Inter Stroy Astana LLP attracted the money of shareholders for the construction of the residential complex "QURMANGAZY".
The construction customer has started construction and installation works at the facility without the appropriate right to land, without design and estimate documentation that has been examined in accordance with the procedure established by law, maintenance of technical and author supervision and notification of the start of construction and installation works, which in turn is a violation of the requirements of the Law of the Republic of Kazakhstan "On Architectural, Urban Planning and Construction activities in the Republic of Kazakhstan".
Thus, a protocol on an administrative offense was drawn up against the developer, he was given an order to eliminate the violations committed.
In compliance with the issued instruction, the developer voluntarily carries out an event to dismantle an illegal object.
We remind you that the attraction of funds from shareholders without appropriate permission is prohibited by the legislation of the Republic of Kazakhstan "On equity participation in housing construction", while liability is provided for under Article 320 of the Code of Administrative Offences of the Republic of Kazakhstan, as well as Article 214 of the Criminal Code of the Republic of Kazakhstan for engaging in prohibited types of entrepreneurial activity.
