The Gambling Regulatory Committee informs debtors on unfulfilled financial obligations

The Committee on Regulation of Gambling and Lottery of the Ministry of Tourism and Sports of the Republic of Kazakhstan (hereinafter – the Committee) reports on incoming appeals from citizens included in the Unified Register of Debtors. The appeals relate to the issues of refund of funds on bets and conducting inspections against bookmakers.
In accordance with the requirements of the Entrepreneurial Code of the Republic of Kazakhstan, the basis for conducting an unscheduled audit against the organizers of the gambling business may be a statement by an individual about a violation of the law if there is sufficient evidence and reasonable grounds.
"When contacting the Committee, it is necessary to attach materials (screenshots of the betting history, personal account, etc.) confirming the betting. If appropriate materials are available, the Committee examines the circumstances on the merits of the appeal and considers the issue of conducting an unscheduled audit against the organizers of the gambling business who committed (at the request of the relevant persons) a violation of the law. The Committee also draws attention to the fact that, according to article 8 of the Civil Code, no one has the right to benefit from unfair behavior. This provision is taken into account when studying the appeals of persons included in the Unified Register of Debtors," Acting Chairman of the Gambling and Lottery Regulatory Committee Adilet Turganbayev said.
In practice, it has been established that some citizens, despite the ban, continue to try to participate in gambling, using, for example, third-party accounts or registering in the register of self-limited through the eGov mobile mobile application after making bets. Such citizens, if they are allowed to participate in gambling and betting by the organizer of the gambling business, if they lose, file complaints about the recovery of lost funds from the organizers of the gambling business, but not if they receive winnings.
The Committee emphasizes that responsibility in such cases lies both with the gambling participant, who is aware of his status in the Unified Register of Debtors, and with the organizer of the gambling business, who allowed such a person to participate in the game without due diligence.
