The notorious case of a low-quality course on state procurement revenue was put to an end in Taldykorgan. The court ruled in favor of consumers who suffered from a coach-trainer promising “quick profits” through a tender, but lost a large amount.
The case began with the complaint of consumer Zhuldyz Idrisova about the actions of a coach who, having encountered poor-quality training services and promised people “million-dollar profits”. She appealed to the Department of Trade and Consumer Rights Protection of the Zhetysu region on this issue. Having analyzed the issue in depth, the department published information on social networks and organized a reception event for citizens on October 11, 2024. On this day, complaints from eight consumers who sought help after purchasing affiliate courses for making money through a tender were considered.
During the inspection conducted by employees of the Zhetysu region’s STKCD, it was found that the coach-entrepreneur did not conclude an official contract and did not issue a fiscal check upon payment - this is a violation of tax legislation. Instead of the promised monthly courses, only 3-4 lessons were held, and then the trainer stopped teaching, citing his "circumstances", which is a direct violation of Article 13 of the Law of the Republic of Kazakhstan "On Protection of Consumer Rights". As a result, citizens were left without education and lost their money. Some consumers, hoping to win "profitable tenders" and get their money back, even went so far as to take out loans.
"The department's employees provided legal assistance to consumers in preparing pre-trial documents against this entrepreneur and demanded a response within 10 days. By not responding to the letter of protest, the entrepreneur violated the law, and therefore an unscheduled inspection was conducted by the department," said Aidos Daueshev, head of the State Consumer Protection Department.
During the inspection, the number of victims of poor-quality service reached 18 people, and consumers from not only the Zhetysu region, but also Almaty, Kostanay and Astana cities also filed complaints. As a result, the total amount of damage increased to 6,593,000 tenge. In order to protect their legitimate interests, the Department filed a lawsuit with the Taldykorgan city court on behalf of more than ten consumers.
During the trial, the coach-entrepreneur returned some of the affected consumers their money: three consumers were fully refunded 850,000 tenge, and the remaining two consumers were partially refunded - 450,000 tenge each. However, the court ruled to fully satisfy all claims and protected the interests of all parties to the case.
Interestingly, another incident was revealed during this case: the coach-trainer had previously won a tender for the renovation of one of the city schools and had not paid the builders. After a dispute on social networks, he quickly paid his debt.
The Department of Trade and Consumer Protection warns that such courses for "easy money" bring despair and losses to citizens. Experts recommend carefully studying the information about trainers, drawing up an official contract and requiring a fiscal check.
