HOW TO PRIVATIZE HOUSING FROM COMMUNAL HOUSING STOCK

On November 22, 2024, the Head of State signed the Law of the Republic of Kazakhstan "On Amendments and Additions to Certain Legislative Acts of the Republic of Kazakhstan on housing policy reform." The provisions of the Law regarding the privatization of housing came into force on December 4, 2024, and now citizens can apply to akimats for privatization. At the same time, in accordance with paragraph 8 of Article 13 of the Law of the Republic of Kazakhstan "On Housing Relations", certain categories have the right to free privatization.: 1) veterans of the Great Patriotic War; 2) persons with disabilities of the first and second groups; 3) participants in the aftermath of the Chernobyl nuclear power plant; 4) victims of nuclear tests at the Semipalatinsk nuclear test site; 5) victims of an environmental disaster in the Aral Sea region; 6) military personnel recognized as persons with disabilities in the defense of the former USSR, including while serving in Afghanistan; 7) military personnel, employees of the CDF, law enforcement agencies with a length of service - 20 years, if there is a child with a disability - 10 years; 8) family members of a serviceman, an employee of the CDF, an internal affairs agency who died while serving; 9) victims of political repression; 10) candidates for cosmonauts, cosmonauts. Other citizens can buy out such dwellings at their residual value, that is, at a cost less physical depreciation of the dwelling from the book value of the dwelling. For reference: the book value of a dwelling is the amount of money spent on the construction or purchase of this dwelling, recorded in the accounting records of the Akimat. Physical depreciation amounts to 2% of the book value of the dwelling annually. To date, the Ministry of Industry and Construction has amended the Rules of Privatization (Government Decree No. 673 of July 2, 2013) in terms of reducing the initial payment to 10% and extending the installment period to 15 years for apartments with a residual value exceeding 15 million tenge, which entered into force on February 3, 2025. At the same time, it should be noted that privatization is a right, not an obligation, and no one will force people to buy out their homes. In order to acquire ownership of housing through privatization, the applicant provides to the PSC either through The following documents have been submitted to the housing Commission for consideration: - an application for the privatization of the occupied dwelling, signed by all adult members of the tenant's family; - employment agreement; - a document confirming belonging to the category of citizens who have the right to receive ownership free of charge. The housing commissions, within thirty calendar days, make a decision on the privatization of housing or issue a reasoned refusal in writing. Moreover, the Law provides for the possibility of re-privatisation of housing from the state housing stock, if this right was exercised before the entry into force of this Law. For reference: According to the current paragraph 9 of Article 13 of the Law of the Republic of Kazakhstan "On Housing Relations", citizens have the right to privatize only one dwelling from the state housing stock in the territory of the Republic of Kazakhstan. However, the current legislation does not prohibit the re-acquisition of housing from the public housing stock. At the same time, we note that state support measures aimed at improving the living conditions of citizens will be provided once.
