The Constitutional Court of the Republic of Kazakhstan has accepted for constitutional proceedings a citizen’s appeal regarding the constitutionality of subparagraph 9) of paragraph 2 of Article 6 of the Law of the Republic of Kazakhstan “On Law Enforcement Service.”

This provision establishes the conditions for joining the law enforcement service, including a permanent ban on serving in law enforcement agencies for certain categories of individuals as stipulated by the Law.

According to the applicant, the contested provision restricts his right to re-enter the service.

The applicant argues that the provision in question does not comply with Regulatory Resolution No. 27-NP of August 31, 2023, as it does not ensure the proportionality of the legal restriction.

Following a preliminary review, the Constitutional Court of the Republic of Kazakhstan has accepted the appeal for constitutional proceedings.
