Anti-monopoly investigation completed in relation to Kcell JSC
10.04.2025 16:54:44 275The antimonopoly authority of the Republic of Kazakhstan completed the investigation against Kcell JSC in connection with the abuse of a dominant position.
The consumer's complaint was the actions of Kcell JSC to write off more than 30 thousand tenge after exceeding the Internet access limit according to the Alga-1 tariff plan and not notifying the consumer about the start of charging for Internet access at a rate of 20 tenge per 1 Mb.
As a result of the investigation, the actions of Kcell JSC revealed the abuse of a dominant position, expressed in establishing the conditions of tariff plans that infringe the legal rights of subscribers in the provision of mobile Internet access services under the Kcell trademark (including not bringing the subscriber information to for higher tariffs when the subscriber exhausts the bonus package of services with limited subscriber's ability to early reconnect tariff plans, inadequate informing subscribers of significant conditions s tariff plans).
Following the results of the investigation, an administrative case was initiated against Kcell JSC, the materials were sent for consideration to the court.
For abuse of dominant position, the object of investigation is threatened with a fine of 5 percent of the income received as a result of monopolistic activity.
In addition, an instruction has been made to Kcell JSC to stop violations of the provisions of the Business Code and eliminate their consequences, including the return of funds to consumers.
