The Constitutional Court Refused to Reconsider the Provision on Monetary Penalty

The Constitutional Court received a petition to review the compliance of Part 4 of Article 127 of the Administrative Procedure and Process Code of the Republic of Kazakhstan with the Constitution. This provision establishes behavioral requirements for participants in administrative proceedings, and for violations, the court has the right to impose a monetary penalty in the amount of 20 MCI (Monthly Calculation Index).
The Constitutional Court noted that it had previously examined Part 9 of Article 127 and Part 4 of Article 171 of the Code for compliance with the Constitution and, as a result, adopted Regulatory Resolution No. 40-NP on January 10, 2024.
In addition, the Constitutional Court explained to the applicant that a ruling on a monetary penalty issued by a lower court may be appealed through appellate and cassation procedures.
