About the pre-trial investigation against citizens of the People's Republic of China M.Әlіmұly and K.Mұsagan

On October 10, the NSC's Border Service launched a pre-trial investigation under part 1 of Art. 392 of the Criminal Code of the Republic of Kazakhstan “Intentional Illegal Crossing of the State Border of the Republic of Kazakhstan” in relation to citizens of China Mұrager Ulimұly and Қaster Mұsagan.

On October 14, they were invited to the Shyғys Regional Office of the Substation in Almaty to clarify the circumstances of the border crossing. In the procedural order, they were not delayed, a preventive measure was not chosen by them. Әlіmұly and Mұsagan voluntarily stayed at the location of Shygys RU, where they were provided with food and overnight.

Previously, both reported that they illegally crossed the border with the PRC on October 1.

In this regard, on October 15, they are scheduled to be delivered to Zaysan, East Kazakhstan Region, to clarify the circumstances of border crossing, as well as conduct procedural and other investigative actions at the site of the alleged offense.

In addition, it was established that on June 21, 2006, Mұsagan already violated the Kazakh-Chinese border in order to evade criminal liability for horse-stealing. Then, after the trial, he was expelled to the PRC.

The KNB border service reports that pre-trial investigation against citizens of the PRC іlimіly and Mұsagan is carried out in full compliance with their rights, as well as in strict accordance with international obligations and the current legislation of the Republic of Kazakhstan.
