No. 270 "Rules for encouraging people who
inform about the fact of a corruption offense or who
provides (provided) assistance in anti-corruption action in a different way" corruption depends on the severity of the offense.
The amount of the bribe or the damage caused, or the value of the offered benefits or the provided
services does not exceed one thousand monthly calculation indicators (hereinafter - MCI) or
one-time monetary
reward for corruption offenses in which no damage has been caused is set in the following amounts:
1) in administrative cases on corruption offenses - 30 MCI;
2) in criminal cases on less serious corruption crimes - 40
MIK;
3) in criminal cases on corruption crimes of medium severity - 50
MIK;
4) in criminal cases on serious corruption crimes - 70 MCI;
5) in criminal cases on serious corruption crimes - 100 MCI.
In the case of corruption offenses in which the amount of the bribe or the damage caused or the benefits offered or the services provided
exceeds one thousand MCI, the one-time monetary reward is ten percent of the amount of the bribe or the damage caused or the benefits offered or the
services provided, but not more than four thousand MCI.
Promotion, if the information provided by the person is true or if the person's assistance in the anti-corruption action in a different way contributed to the detection, suppression, discovery and investigation of the corruption offense, and in relation to the accused person:
1) the court decision on the imposition of an administrative penalty has entered into legal force;
2) the conviction has entered into legal force;
3) On the basis of subsections 3),
4),
9), 10), 11) and 12) of the first part of Article 35 of the Code of Criminal Procedure of the Republic of Kazakhstan, or on the basis of Article 36, the decision of the court on the termination of the criminal case has entered into legal force, and the decision of the criminal prosecution body on the termination of the criminal case has been approved by the prosecutor.
The following documents are required to receive a reward:
assistance
1) an anti-corruption
action
in accordance with the form in accordance with Appendix 1 to these Rules
(hereinafter - application);
application
for promotion
2) identity document (identity card, certificate of a stateless person,
residence permit of a
foreigner) in the original or through a digital document service;
3) certificate from the second level bank about the existence and
number of the current bank account of the specified person in national currency.
The provisions of these Rules do not apply:
1) to a person who has
reported false information about the fact of a corruption offense and is liable under the laws of the Republic of Kazakhstan;
2) to a person who cooperates on a confidential basis with the body carrying out operational search or counter-intelligence activities in accordance with the legislation of the Republic of Kazakhstan;
3) does not apply to a person who reported the fact of a corruption offense or provided assistance in the detection, prevention, detection and investigation of a corruption offense and was found to be an executor or an accomplice.
