From the appeals of citizens it follows that on the street a person comes up to them and offers to pull out an envelope from a win-win lottery of various gifts such as a vacuum cleaner, microwave irons, etc. To receive a gift, they are invited to cafes and restaurants in the city.
In luxury restaurants and cafes, "free" gifts are then additionally presented with massage capes.
At the presentation, the organizers of the action, if the money is not available, instantly through the Caspian application, the People's Bank issue a loan. In addition, an agreement is signed between the seller and the buyer, the Loan is issued for different periods depending on the credit history
As a result, the "free gifts" campaign costs consumers about more than 1000,000 (million) tenge. And only at home, according to the citizens who applied, they realize that they have signed an agreement and issued a loan, having bought massage capes, at a price ten times higher than the market value.
If you find yourself in a similar situation and entered into an agreement with the seller, you have issued a loan for the purchase of goods.
In accordance with Article 14 of the Law of the Republic of Kazakhstan "On Protection of Consumer Rights," the buyer has the right to return the money within fourteen days from the date of transfer of non-food goods to him.
Accordingly, it is necessary to write a pre-trial claim to the seller independently with a request to return the money or contact the Department for legal assistance at the address: Kostanay, pr. Al-Farabi, 115/1 or by e-otinish.kz.
In turn, the seller is obliged to respond to the buyer's claim within 10 calendar days. At the same time, you will need to return the goods and gifts to the seller.
Additionally, apply with a written statement to the bank indicating that the seller uses aggressive marketing sells a product with 100% cheating with elements of hypnosis and spraying chemicals causing euphoria. Since the bank maintains a list of unscrupulous sellers and subsequently blocks bank accounts.
It happens that there is no seller at the legal address specified in the contract, in this case it is necessary to go to court to terminate the contract and return the money.
The Department of Trade and Consumer Protection of Kostanay region recommends not to participate in dubious events in order to avoid such situations.
