A citizen appealed to the Constitutional Court requesting that it review a provision of the Code of Criminal Procedure which allows the court of cassation to uphold sentences and rulings without change and to reject motions for review. In the applicant's opinion, paragraph 1) of part seven of Article 494 of the Code of Criminal Procedure restricted his right to judicial protection.

The Constitutional Court noted that the procedure for cassation review was determined by law and fell within the competence of the legislature. The Constitutional Court only reviews the constitutionality of laws and does not assess the circumstances of specific cases. The applicant exercised his right and his petition was subject to judicial review. As a result, it was established that there were no grounds for reviewing the constitutionality of the contested provision, and the petition was rejected.
