Vienna, 24 March 2026 – The delegation of the Republic of Kazakhstan took part in the 54^th session of UN Сomission on International Trade Law (UNCITRAL) Working Group III: Investor-State Dispute Settlement Reform.

The Working Group continues its consideration of the possible establishment of a standing mechanism for the resolution of international investment disputes, including various models of an Appellate Tribunal and the procedure for determining its jurisdiction.

During the session, the delegation of Kazakhstan, participating as an observer State, underscored the importance of ensuring legal certainty and taking into account the specific features of national procedures when considering possible mechanisms for establishing the jurisdiction of the tribunal. It was noted that, in the context of the investment tribunal under discussion, an approach based on the express consent of the parties to submit disputes to such a mechanism appears to be more justified from both legal and practical perspectives.

The Republic of Kazakhstan reaffirmed its readiness to continue its constructive participation in the work of UNCITRAL.
