The role of a creditor in bankruptcy proceedings of legal entities in the Republic of Kazakhstan is of great importance for ensuring the legality and fairness of the process. The main task of a creditor is to protect their property interests and ensure the maximum possible repayment of the debt. An important role is also played by the committee of creditors, which makes decisions on major issues of the bankruptcy procedure, including the sale of the debtor's property and the distribution of funds.
Creditors also have the right to challenge the debtor's transactions if they believe that such transactions were carried out with the intention of concealing assets or infringing upon the rights of other participants in the proceedings. This opportunity promotes transparency and prevents unfair actions on the part of the debtor. In addition, the active participation of creditors helps maintain a balance of interests between the debtor and all interested parties. The legislation of the Republic of Kazakhstan "On rehabilitation and bankruptcy" provides mechanisms for protecting the rights of creditors, thereby contributing to the strengthening of financial discipline among legal entities.
