Tax Debt: What Measures Are Applied for Late Payment?

Failure to pay taxes and social contributions may result not only in the accrual of penalties but also in enforcement measures предусмотренные by the tax legislation of the Republic of Kazakhstan.

First Stage — Notification

When a tax debt arises, the state revenue authorities issue a notification requiring its repayment. For business entities, notifications are issued when tax arrears exceed 20 MCI and social payment arrears exceed 6 MCI. Taxpayers are given 10 working days to settle the debt voluntarily.

Restrictive Measures

If the debt is not repaid within the established period, measures to secure the fulfillment of tax obligations may be applied, including:

▪ suspension of expenditure transactions on bank accounts;
▪ restriction of cash expenditure operations;
▪ issuance of collection orders to second-tier banks.

Travel Restrictions

For heads of legal entities and individual entrepreneurs with outstanding debts remaining unpaid for more than three months, legislation provides for temporary restrictions on leaving the Republic of Kazakhstan.

Enforced Collection

If the debt is not repaid voluntarily, the state revenue authorities may apply additional enforcement measures, including:

▪ recovery of debt from bank accounts;
▪ recovery through accounts receivable;
▪ restriction on the disposal of property followed by its sale in accordance with the established procedure.

For Individuals

If a tax debt exceeds 1 MCI, a tax order is issued and forwarded to enforcement officers for execution in accordance with the law.

Publication of Information on Debtors

Information on taxpayers with outstanding liabilities to the budget is published in open sources in accordance with the procedure established by law.

How to Avoid Negative Consequences?

• Fulfill tax obligations on time;
• Regularly check for outstanding debts;
• Monitor penalty accruals;
• Use the e-Salyq Azamat and e-Salyq Business services to obtain up-to-date information on settlements with the budget.

Timely payment of taxes is not only a legal obligation but also a guarantee against financial and administrative restrictions.
