Bankruptcy Procedures Have Been Fully Digitalized

The bankruptcy framework in Kazakhstan, which has been developing since March 2023, has fully transitioned to an electronic format. Automation of interaction between administrators, creditors, and the state has eliminated paper-based document flow and reduced procedural timelines to a minimum.
Rehabilitation and bankruptcy procedures for legal entities and individual entrepreneurs are available through the Taxpayer Cabinet.
The following services have been launched nationwide:
- official bankruptcy notices are received and published automatically;
- creditors and government authorities can monitor the progress of procedures in real time;
- prompt electronic access to information about debtors is provided.
At the same time, clear deadlines have been established for reapplying for bankruptcy after a refusal, as well as for submitting the final report and liquidation balance sheet to the court.
The calculation of additional remuneration for bankruptcy administrators has been revised, and administrative expenses incurred when procedures are extended have been clarified.
The rehabilitation procedure does not apply if an enterprise has no creditors other than the state in respect of taxes and mandatory payments.
The out-of-court bankruptcy procedure for individuals has become as accessible as possible. The Qoldau system enables creditors to promptly submit complaints electronically if they disagree with decisions of the state revenue authorities.
New legislative amendments have significantly accelerated procedures for individuals: for debtors whose total debt does not exceed 1,600 Monthly Calculation Indices (MCI) and whose obligations have remained unfulfilled for more than 5 years, the period for conducting the out-of-court bankruptcy procedure has been reduced to 1 (one) month.
Obligations to pawnshops are no longer taken into account when applications are considered, and pawnshops themselves have been completely excluded from the list of creditors under this procedure.
