Current Issues in the Application of Bankruptcy Legislation Discussed at the AFK Platform

On September 4, 2026, a round table entitled “Issues in the Application of Bankruptcy Legislation” was held in Almaty at the platform of the Association of Financiers of Kazakhstan (AFK), chaired by Seilzhan Adilkhanovich Akhmetov, Deputy Chairman of the State Revenue Committee of the Ministry of Finance of the Republic of Kazakhstan, with the participation of representatives of the banking sector.
The meeting addressed issues related to the application of bankruptcy legislation concerning individuals and legal entities, as well as proposals from the banking sector aimed at improving law enforcement practices.
Particular attention was paid to the digitalization of judicial bankruptcy and solvency restoration procedures for citizens. A dedicated workspace for creditors and financial managers is being developed within the Qoldau information system, with integration with credit bureaus. The new functionality will facilitate electronic interaction among participants, reduce paperwork, and accelerate the preparation of the register of creditors’ claims.
The participants also discussed proposals to improve legislation on the bankruptcy of citizens, including the possibility of discharging obligations under budget loans provided as part of the “With a Degree to the Village” social programme, as well as establishing a restriction period for re-applying to court for judicial bankruptcy or solvency restoration procedures where an application has been rejected or a procedure has been terminated due to the debtor’s unlawful actions.
Another part of the discussion focused on improving bankruptcy procedures for legal entities.
Following the round table, the participants exchanged proposals aimed at improving law enforcement practices and further developing bankruptcy legislation.
