What kind of support will domestic business receive in the new law on public procurement

The Ministry of Finance of the Republic of Kazakhstan explains the changes in the law on public procurement in Karaganda. At the meeting, representatives of the business community of the Karaganda region, employees of government agencies, budget organizations, SMEs and representatives of the regional NCE "Atameken" learned about the support of domestic producers by optimizing procurement procedures.
The law will enter into force on January 1, 2025, so it is already important to know the changes in order to prepare for them, said Kazakh Finance Minister Madi Takiev and Akim of Karaganda region Ermaganbet Bulekpayev.
"In general, the law is aimed at optimizing the procedures of the procurement process, improving the quality of purchased goods, works and services, strengthening the responsibility of participants in public procurement and developing competition. For example, the first block of the law's novelties is aimed at simplifying and reducing procurement procedures. So, in order to carry out purchases promptly, provide greater powers to customers, as well as avoid delaying procurement procedures, complaints will now be considered directly by the procurement organizer himself. The appeal of the procurement results will be carried out through the web portal and only for purchases, where the winner is determined by the competition commission," said Madi Takiev, Minister of Finance of the Republic of Kazakhstan.
Information about the supplier will be generated through the extensive use of data from information systems of government agencies.
Another block of short stories is aimed at developing competition. Thus, a single procurement platform based on a single public procurement operator, JSC Center for Electronic Finance, has been introduced by law, which provides a single access point to electronic public procurement and procurement services for quasi–public sector entities. In addition, the tender period has been reduced from 2 months to 10 working days. The procedure for appealing the results of public procurement has also been revised and simplified.
"As part of the execution of the instruction of the Head of State on the demonopolization of the construction market, as part of the implementation of the new Law, measures for the demonopolization of economic spheres have been reflected. In particular, when calculating conditional discounts, the application of price criteria in the form of a territorial feature (increased from 1% to 2%) and negative values (increased from 0.1% to 0.2%) continued. These measures will make it possible to evenly and fairly distribute the volume of public procurement and eliminate the monopoly position of individual companies," said Vice Minister of Finance Dauren Kenbeil.
In addition, in order to support domestic producers, the Ministry of Finance of the Republic of Kazakhstan has approved a separate list of goods, works and services that will be purchased exclusively from small and medium-sized businesses.
The new law on public procurement will improve the quality of purchased goods, works, services, strengthen the responsibility of potential suppliers and provide support to domestic producers.
