Constitutional Court: voluntary consent to the terms of the employment contract confirms the realization of the right to freedom of work 11.06.2025
Теlegram CС - https://t.me/consot_kz  The Constitutional Court received a citizen's appeal to check the constitutionality of paragraph 4 of Article 137-1 of the Labor Code of the Republic of Kazakhstan. The circumstances set out in the appeal concerned the termination of an employment contract concluded for the time of performance of certain work. The employee was sent by the employer to another organization to perform a work function. The termination of the employment contract was effected in connection with the receipt of a written notice from the receiving party, as provided for by the contested provision of the Labor Code. The applicant had previously brought an action in the courts against both parties to the employment relationship, claiming that the termination of the employment contract was unlawful and referring to the absence of clear terms on the duration of the work to be performed. The courts refused to satisfy the claims. The citizen believes that this norm of labor legislation violates his right to work. The Constitutional Court stated that the contested norm does not prevent citizens from exercising their constitutional right to work. The conclusion of an employment contract on terms, including its term, is the result of a voluntary agreement between the parties. Thus, a citizen, by accepting the terms of the contract, realizes his right to freedom of labor.Based on the above, the Constitutional Court concluded that there were no grounds to accept the appeal for constitutional proceedings.Source : https://www.gov.kz/memleket/entities/ksrk/press/news/details/1015101?lang=kk

A sports event aimed at developing honesty and discipline among young people was held in Almaty 11.06.2025
The Department of the Agency of the Republic of Kazakhstan for Combating Corruption in Almaty, within the framework of the "Law and Order" narrative, together with the NGO "Grappling Wrestling Federation UWW", organized a sports event attended by about 400 young athletes, children and adolescents. The event was aimed not only at supporting the development of mass sports, but also at forming key moral guidelines for the younger generation. Sport is not just about physical development, but also a powerful tool for fostering inner stability, fortitude, honesty and a sense of responsibility. During the event, the head of the Anti—Corruption Service of Almaty, Arman Rakhimov, addressed the participants with an important thought: power is needed not to dominate, but to protect the Motherland, family, the weak and the needy. Sport is not aggression, but the ability to control oneself. On this path, the winner is not the one who is physically stronger, but the one who has discipline, honesty and moral fortitude. At the end of the event, letters of thanks were presented to the organizers, coaches and the most active participants for their contribution to the organization of the competition, initiative, commitment to the spirit of fair play and a worthy example for their peers. This is a contribution to the education of a generation capable of building a just and sustainable society. Separate words of gratitude were expressed to the parents for taking care of the children, for the time, efforts and resources invested. It is in the family that the foundation is being formed on which the future of the country is being built. The participation of children from orphanages was of particular importance. For them, such events are an opportunity to feel their importance, to believe in their own strength and to unleash their inner potential. This event was not just a series of sports matches, but a vivid example of how the character of a new generation is being formed. Discipline, honesty, respect, striving for development and following the law — these qualities are equally important both in sports and in life.#Law and Order#LAW and ORDERSource : https://www.gov.kz/memleket/entities/anticorruption-almaty/press/news/details/1014977?lang=kk

Current questions about UAPF Payment of pension savings from UAPF according to the schedule: how pension benefits are calculated and where to apply 10.06.2025
Current questions about UAPFPayment of pension savings from UAPF according to the schedule: how pension benefits are calculated and where to apply Who is entitled to pension benefits according to the schedule?Monthly pension benefits according to the established schedule from the UAPF in accordance with the Social Code of the Republic of Kazakhstan are paid to persons who have pension savings at the expense of the CPC and (or) the COPC in the UAPF:- who have reached retirement age (men - 63 years old, women - 61 years old);- with disability of group 1 or 2, established indefinitely;- who have reached 55 years old, if the COPC has been paid in their favor in total at least 84 calendar months at the time of applying for a pension benefit, subject to termination of employment in jobs with hazardous working conditions or upon transfer to another job that excludes exposure to harmful factors (hereinafter - persons who have reached 55 years old, for whom the COPC has been paid in total for at least 84 calendar months), in the manner determined by the Government of the Republic of Kazakhstan. How are pension benefits according to the schedule calculated? Pension benefits according to the schedule are calculated as follows: in the first year of receiving benefits, the amount of pension savings is multiplied by the pension benefit rate of 6.5% and divided by 12. In subsequent years, the amount of the monthly pension benefit is increased by the pension benefit indexation rate of 5%. In this case, the monthly pension benefit payment from the UAPF is made in the amount of at least 70% of the subsistence minimum (hereinafter - SM) established for the relevant financial year by the law on the republican budget (in 2025, the SM is 46,228 tenge), with the exception of persons who have reached 55 years of age, for whom COPC has been paid in total for at least 84 calendar months. For beneficiaries of certain categories: persons with disabilities of groups 1 or 2, established indefinitely, as well as persons who have reached retirement age and have pension savings formed through compulsory occupational pension contributions in total for at least sixty months, the Methodology provides for correction factors that increase the amount of the monthly pension benefit. For persons who meet more than one of the above conditions, the correction factor with the highest value is applied. If the amount of pension savings on the date of payment from the UAPF does not exceed twelve times the minimum pension established by the law on the republican budget for the relevant financial year (in 2025, 753,252 tenge = 62,771 x 12), the payment is made in a lump sum.Correction factors do not apply to persons who have reached 55 years of age, for whom COPC has been paid in total for at least 84 calendar months. Where and when should I apply for payment of my pension savings from the UAPF? To assign pension benefits from the UAPF at the expense of mandatory types of pension contributions in connection with reaching the retirement age, as well as the assignment of a basic and PAYG pension from the state budget, beneficiaries must promptly contact the State Corporation "Government for Citizens" (PSC) at their place of residence. This can be done 10 days before reaching the retirement age. All types of pension benefits are made from the date of application. In this case, the day of application is considered to be the day of registration of the application and the necessary documents in the PSC, provided that the beneficiary has reached the retirement age, if he applied earlier - the day of application is considered to be the day of reaching the retirement age. Timely application is especially important for receiving benefits from the budget, for the assignment of which it is necessary to verify the work experience based on the documents submitted by the beneficiary. Where should disabled persons with pension savings in UAPF apply?? For payment of pension savings in connection with the establishment of disability, you must contact the UAPF departments either through your personal account on the website (enpf.kz) or in the UAPF mobile application using an electronic digital signature. Please note that UAPF has organized on-site services for persons with disabilities. In this case, a preliminary consultation is carried out, including checking the possibility of receiving services remotely, without leaving Where should persons who have reached the age of 55, for whom COPC has been paid for a total of at least 84 calendar months, apply?Pension benefits at the expense of compulsory occupational pension contributions to persons who have reached 55 years of age, for whom COPC has been paid in total for at least 84 calendar months, are assigned through the provision of a proactive service within the framework of the assignment of a special social payment or by applying to the State Corporation with the presentation of an identity document, as well as information about the bank account. If the said person has pension savings formed at the expense of compulsory pension contributions, then this person may be assigned additional pension benefits from the UAPF at the expense of compulsory pension contributions, if he or she consents to receive them What actions does UAPF take in relation to pensioners who have not applied for pension benefits?Future pensioners (potential beneficiaries), whose phone numbers are registered in the egov mobile citizens database, receive an SMS notification from number 1414 2 months before reaching retirement age about the possibility of timely contacting the nearest branch of the State Corporation to receive services for the appointment of pension benefits with a link to the list of documents on the egov.kz website. That is, government agencies send out relevant notifications to process pension benefits within the specified timeframes, since payments are not assigned for the missed period. It is also worth noting that in order to provide a proactive service for paying pension benefits from UAPF to persons who have reached retirement age, who have pension savings due to CPC and (or) COPC in UAPF and have not applied for their benefit, UAPF conducts an annual reconciliation together with the State Corporation for the presence of assigned pension benefits by age and (or) state basic pension benefit at the expense of budgetary funds for these citizens. Based on the results of the annual reconciliation, when identifying persons who have assigned pension benefits from budgetary funds, UAPF pays pension benefits to them within the framework of the relevant agreement concluded with the State Corporation, i.e. without an application.       Source : https://www.gov.kz/memleket/entities/almobl-uigur/press/news/details/1014815?lang=kk
