The Constitutional Court will review the constitutionality of restricting pension rights for citizens who have moved abroad for permanent residence

Following a preliminary examination, the Constitutional Court has accepted for constitutional proceedings the request submitted by the Judicial Panel for Administrative Cases of the East Kazakhstan Regional Court. The request concerns the constitutionality of the following provisions: paragraph 1 of Article 196, paragraph 2 of Article 202, subparagraph 2) of paragraph 3 of Article 204 of the Social Code, and part five of paragraph 5 of the Rules for calculating (determining) the amount, assignment, implementation, suspension, recalculation, resumption, termination, and review of decisions regarding the assignment (or refusal of assignment) of state basic pension payments and age-based pension payments (Order of the Deputy Prime Minister – Minister of Labor and Social Protection of the Population of the Republic of Kazakhstan dated June 22, 2023, No. 232).
The petitioner believes that the contested provisions of the Code and the Rules discriminate against the pension rights of citizens who have moved abroad for permanent residence compared to the rights of citizens who permanently reside in the Republic of Kazakhstan, since both categories of citizens have fulfilled their obligations to the state and society by engaging in employment and paying taxes.
