Constitutional guarantees of non-discrimination and equal rights form the foundation of state policy aimed at supporting and upholding the rights of persons with disabilities. This policy encompasses areas such as the creation of a barrier-free environment, inclusive education, social support, and more. In the course of its activities, the Constitutional Court of the Republic of Kazakhstan has reviewed a number of petitions from citizens with disabilities and issued rulings aimed at ensuring the supremacy of constitutional guarantees.

For example, on July 26, 2024, the constitutional oversight body adopted Regulatory Resolution No. 50-NP https://www.gov.kz/memleket/entities/ksrk/documents/details/697428?lang=en, which states that persons with disabilities must be exempt from paying state fees at the stage of appealing court decisions, not only as plaintiffs but also as defendants. This provision has now been brought into alignment with the Constitution in the draft of the new Tax Code, which has been approved by the Mazhilis of Parliament in its first reading.

Moreover, the launch of the constitutional review prompted a prosecutorial investigation and led the authorized ministry https://t.me/consot_kz/1278 to eliminate an unlawful requirement, previously set by ministerial order, demanding that persons with disabilities present an additional document when boarding railway transport.
