Kazakhstan intensifies the fight against vaping: new rules and severe liability

Customs authorities of the Republic of Kazakhstan, one of the key tasks of which is the protection of national and economic security, life and health of citizens, inform about an important change in the legislation.
New Law: Ban on import, production and sale of vape devices
On April 19, 2024 the Head of State signed the Law of the Republic of Kazakhstan “On introducing amendments and additions to some legislative acts of the Republic of Kazakhstan on health issues”, which came into force on June 20, 2024.
This Law introduces significant amendments to the Code of the RK “On the Health of the People and the Health Care System”. In particular, Article 110 now expressly prohibits the import, manufacture, sale and distribution of:
- Non-cigarette tobacco products.
- Electronic consumption systems (vapes).
- Flavorings and liquids for vapes.
In addition, the ban applies to smoking tobacco products, products with heated tobacco, hookah tobacco, hookah mixtures and systems for heating tobacco that exceed the maximum permissible levels of nicotine and resinous substances, as well as those for which no sanitary and epidemiological requirements have been established.
Increased criminal liability
Along with these changes, a new Article 301-1 has been introduced into the Criminal Code of the Republic of Kazakhstan, establishing liability for violating this prohibition.
Consequences for sale and distribution:
- The sale and distribution of smokeless tobacco products, vapes, flavors and liquids for them is punishable by:
- A fine of up to 200 MRP.
- Or correctional labor in the same amount.
- Or community service for up to 200 hours.
- Or arrest for up to 50 days.
Stricter measures for importation and production:
- For those who attempt to import or manufacture prohibited products in the territory of the RK, there are significantly more severe penalties:
- A fine of up to 2,000 MRP.
- Or imprisonment for up to two years with confiscation of property.
Increased liability in case of repeated violations or in a group of persons:
- If the above acts are committed by a group of persons or repeatedly, the punishment can reach up to five years of imprisonment.
Customs authorities urge citizens and business entities to strictly comply with the new legal requirements in order to avoid legal liability.
