The Constitutional Court will review the constitutionality of the provision on dismissal at the employer's initiative

Based on the results of a preliminary review, the Constitutional Court of the Republic of Kazakhstan accepted for constitutional proceedings a citizen's appeal to verify the constitutionality of subparagraph 2) of paragraph 1-1 of Article 52 of the Labor Code of the Republic of Kazakhstan.
The contested provision provides for the possibility of terminating an employment contract at the initiative of the employer in the event that an employee of a quasi-public sector organization commits a corruption offense.
The applicant, who was previously dismissed from his position as an electric locomotive driver on these grounds, believes that this provision restricts his constitutional rights to freedom of labor and freedom to choose his occupation and profession. In his opinion, the provision is applied broadly, without taking into account the nature of the work performed, and does not differentiate between positions related and unrelated to the performance of managerial functions.
