The Price of Mistake: An Administrative Fine: How the Department Defended Consumer Rights

Consumer protection remains a priority area of state policy in the trade sector. Regional trade and consumer protection departments in the Republic of Kazakhstan continue to actively respond to citizen complaints, ensuring the restoration of their legal rights and interests.
The Shymkent Department of Trade and Consumer Protection of the Ministry of Trade and Integration of the Republic of Kazakhstan received a complaint from citizen A., who purchased gold jewelry online. After receiving the item, the buyer discovered a defect and contacted the seller, demanding a replacement or refund. However, the seller refused to honor this legal demand.
The consumer submitted a written statement to the Department, enclosing photographs and videos, a cash register receipt, and a copy of the claim letter. Based on the complaint, an unscheduled inspection was conducted in accordance with the Entrepreneurship Code of the Republic of Kazakhstan.
The inspection found that the seller violated the procedure and timeframe for reviewing complaints stipulated by the Law of the Republic of Kazakhstan "On the Protection of Consumer Rights." Administrative measures were taken against the business entity under Article 190, Part 5 of the Code of Administrative Offenses. Following the inspection, the seller acknowledged the violation and refunded the buyer 95,000 tenge, fully satisfying the consumer's demands.
A similar incident was recorded at a branch of a large retail chain in Shymkent. The customer discovered a discrepancy between the price on display and the amount indicated on the receipt—1,990 tenge versus 2,990 tenge. Following the citizen's complaint, the Department of Trade and Consumer Protection conducted an inspection, which resulted in the entrepreneur being issued an order to rectify the violations and an administrative violation report being filed.
Citizens who have encountered unfair practices on the part of sellers or service providers can count on effective support, an objective review of their complaints, and the protection of their interests in accordance with the laws of the Republic of Kazakhstan.
