On Amendments and Additions to Certain Legislative Acts on Intellectual Property Issues

In November of this year, the Head of State signed the Law of the Republic of Kazakhstan “On Amendments and Additions to Certain Legislative Acts on Intellectual Property Issues.”
The Law is aimed at strengthening protection in the field of intellectual property.

Key amendments introduced to the legislative acts of the Republic of Kazakhstan on intellectual property issues:

The main innovation in the protection of intellectual property rights is the Unified Digital Platform (UDP) for collective rights management. It will allow the use of works and the calculation of remuneration to be recorded in a single system, ensuring transparency and convenience for both authors and users. The introduction of the platform will make the collection and distribution of remuneration fair.

The specified remuneration is distributed by an expert organization among collective management organizations in accordance with this Law.
The amount, procedure for collection, distribution, and payment of remuneration are determined by the authorized body of the Republic of Kazakhstan.
Digitalization will help enhance transparency and efficiency in the field of intellectual property.

In addition, persons with visual impairments are granted the right to use published works without the author’s permission and without payment of remuneration.

The accelerated trademark registration period has been reduced to 3 months.
The period for filing objections against trademark registration has been extended from 1 to 2 months.
State control over the use of copyright and related rights objects has been strengthened.

Amendments have also been introduced to the Civil Code of the Republic of Kazakhstan (Special Part), the Entrepreneurial Code, the Code “On Customs Regulation in the Republic of Kazakhstan,” and the Laws “On Copyright and Related Rights,” “On the Protection of Breeding Achievements,” the Patent Law of the Republic of Kazakhstan, “On Trademarks, Service Marks, Geographical Indications and Appellations of Origin of Goods,” “On the Legal Protection of Topographies of Integrated Circuits,” and “On Justice Bodies.”

Some amendments—particularly those related to the trademark registration procedure and the digital platform—will enter into force in 2026.
