Prohibition on Civil Servants’ Participation in Gambling

Today, greater importance is being placed on issues of ethics and conduct among civil servants. Adherence to ethical standards holds a special place within the civil service system.
Efforts are underway to prevent the rise of gambling addiction, including among civil servants.
In accordance with Law No. 116-VIII of the Republic of Kazakhstan dated July 8, 2024 No. 116-VIII (effective as of September 9, 2024), paragraph 1 of Article 12 of the anti-corruption restrictions of the Law of the Republic of Kazakhstan “On Combating Corruption” has been supplemented with subparagraph 6, which prohibits civil servants from participating in gambling and betting.
It must be acknowledged that the formation of public opinion regarding civil servants is to a certain extent linked to their conduct outside of working hours. In this regard, the Code of Ethics stipulates that:
- Civil servants must adhere to generally accepted moral and ethical standards during their off-duty hours, exercise modesty, refrain from emphasizing or exploiting their official position when receiving relevant services, and avoid antisocial behavior that infringes upon public morality.
Thus, in accordance with subparagraph 10) of paragraph 6 of Chapter 3 of the Code of Ethics for Civil Servants of the Republic of Kazakhstan, civil servants must refrain from visiting gambling establishments, except in cases related to the performance of official duties.
Pursuant to paragraph 4 of Article 12 of the Law, failure by individuals to accept anti-corruption restrictions results in refusal of appointment or dismissal (removal from office, termination of powers); failure to comply with such restrictions constitutes grounds for dismissal (removal from office, termination of powers).
For officials regarding whom information is received about participation in gambling, a direct legislative ban on such activities has been introduced. Violation of this ban results in removal from office.
