Prohibition on the participation of civil servants in gambling

Today, issues of ethics and conduct of civil servants are given greater importance. The observance of ethical standards occupies a special position in the public service system.

Work is underway to prevent the growth of ludomania, including among government employees.

In accordance with the Law of the Republic of Kazakhstan dated 07/08/24 № 116-VIII (effective from September 9, 2024), paragraph 1 of Article 12 of the Anti-Corruption Restrictions of the Law of the Republic of Kazakhstan "On Combating Corruption" was supplemented with subparagraph 6, which provides for a ban on the participation of civil servants in gambling and betting.

It should be recognized that the formation of public opinion in relation to civil servants is to some extent related to their behavior during off-duty hours. In this area, the Code of Ethics stipulates that:

- Civil servants should adhere to generally accepted moral and ethical standards during off-duty hours, show modesty, do not emphasize or use their official position when receiving appropriate services, and avoid cases of antisocial behavior involving an encroachment on public morality.

Thus, in accordance with subparagraph 10) of paragraph 6 of Chapter 3 of the Ethical Code of Civil Servants of the Republic of Kazakhstan, civil servants must refrain from visiting gambling establishments, except in cases related to the performance of official duties.

According to paragraph 4 of Article 12 of the Law, non-acceptance of anti-corruption restrictions by persons entails refusal to accept a position or dismissal (dismissal from office, termination of powers), non-compliance with them is the basis for dismissal (dismissed from office, termination of powers).

A direct legislative ban on such activities has been introduced for officials in respect of whom information about the facts of gambling will be received. Violation of this prohibition entails dismissal from office.
