The Department of State Revenue for the Karaganda region recalls the importance of protecting intellectual property rights.

In the context of the digitalization of the economy, IT products, brands, franchises and innovative developments are becoming key business assets. At the same time, the risks of illegal use of trademarks and distribution of counterfeit products are increasing.

The use of a trademark or a designation confusingly similar to it without the consent of the copyright holder is considered a violation.

If customs control reveals signs of infringement of intellectual property rights included in the relevant registers, the release of goods may be suspended for up to 10 working days.

At the request of the copyright holder and upon filing a statement of claim with the court, the suspension period may be extended for another 10 working days.

When a civil case is initiated, the time limits for suspending the release and temporary storage of goods are extended until the court decision enters into force.

Illegal use of someone else 's trademark entails administrative liability:

, for individuals — 20 MCI;
🏢 for small businesses and NGOs — 30 MCI;
, for medium — sized businesses - 40 MCI;
, for large business entities — 80 MCI.

It also provides for the confiscation of goods that are the subject of an offense.

The protection of intellectual property contributes to the development of fair competition, strengthening business and creating a favorable investment climate in Kazakhstan.
