Nowadays, it is simply impossible to imagine our lives without mobile phones. Manufacturers advertise new models almost every day. Buying a modern new phone is a dream for many people, and some are even willing to take out a bank loan to make that dream come true. All the more disappointing, therefore, when the phone breaks down.

At first, consumers often try to resolve the issue themselves. They attempt to exchange the phone at the store for a working one or return the defective product, but are refused by the sellers. However, sellers are often in no hurry to comply with the requirements of the law.

This is largely because buyers often fail to obtain documents confirming their purchase. They do not keep receipts or warranty cards. When a consumer does not receive or retain these documents, they create additional problems for themselves.

First of all, the receipt contains all the seller's details, making it much easier to identify and contact the seller if the phone breaks down. Secondly, the receipt serves as proof that the phone was purchased specifically from that particular store.

A warranty card is also an important document confirming the purchase. However, buyers should be attentive and check whether the warranty card bears a stamp and, if so, which stamp has been affixed.

These documents can be extremely useful if the device becomes defective. Under the current Law of the Republic of Kazakhstan “On Protection of Consumer Rights,” a buyer may also use witness statements to prove the fact of purchase if the necessary receipt and warranty documents have been lost. Nevertheless, it is much easier and more sensible to keep the sales receipt and warranty card.

According to the Law on Protection of Consumer Rights, a buyer has the right to demand that a defective phone be replaced with an identical working device. A consumer may also demand reimbursement for the cost of repairing the phone by another organization. If the consumer wishes, they may demand a refund of the purchase price of the defective phone. However, the consumer must choose one of these remedies.

It should also be noted that the defect in the phone must be proven. It must also be established that the consumer did not cause the damage themselves, for example, by dropping or immersing the phone in water.

Technical examinations are carried out by service centers and specially accredited organizations. If it is determined that the consumer was not responsible for the defect, the seller must comply with the consumer's request to replace the phone or refund the money.

If the examination results raise doubts, the consumer may obtain an independent assessment of the phone's technical condition at their own expense by contacting another service center.

Having the examination results, along with all other relevant documents, significantly increases the consumer's chances of successfully resolving the dispute in court.
