WHAT DEBTS ARE NOT DISCHARGED IN BANKRUPTCY?

According to the Law of the Republic of Kazakhstan "On Restoration of Solvency and Bankruptcy of Citizens of the Republic of Kazakhstan," there is a list of obligations that are not subject to termination (discharge) even after the completion of bankruptcy or solvency restoration procedures.

These debts include:

Alimony / Child Support: Obligations to pay alimony to persons entitled to receive it.

Harm to Life or Health: Compensation for damage caused to a person's life or health.

Criminal Offenses: Compensation for damages resulting from the commission of criminal offenses.

Payments to the Budget: Revenue payments to the budget that are recovered by court decision.

National Bank Claims: Claims arising in accordance with the Law of the Republic of Kazakhstan "On the National Bank of the Republic of Kazakhstan."

Manager’s Remuneration: Unpaid (in full or in part) remuneration of the financial manager who conducted the procedure.

Furthermore, the termination of obligations does not apply to debtors who act as guarantors, sureties, or pledgors for the obligations of third parties.

It is important to note that even after the successful completion of the solvency restoration procedure, the debtor's obligation to fulfill the above-mentioned claims (alimony, harm to life, etc.) remains in full force and effect.
