IMPORTING GOODS FROM THE EAEU: WHEN IS IT CONSIDERED BUSINESS ACTIVITY?

Key point: if an individual imports goods from EAEU member states into Kazakhstan in quantities or at a value exceeding the established criteria, such import is considered to be carried out for business purposes.
1. What value of goods can be imported?
Importing goods is considered to be for business purposes if, during a calendar year, the value of the imported goods exceeds 360 times the MCI established as of January 1 of the relevant financial year.
2. There are also quantity limits
Within one year, the import is considered to be for business purposes if, per person, the following quantities are exceeded:
- fur products, including fur headwear - more than 1 item of the same type;
- mobile phones - more than 2 units;
- tablets - more than 2 units;
- desktop and portable computers and accessories - more than 2 units;
- jewellery - more than 5 items;
- bicycles - more than 1 unit;
- baby strollers - more than 2 units;
- vehicles, including vehicles in unassembled form - more than 1 unit.
Important
These criteria do not apply to used goods that are necessary during the journey and/or at the destination.
The following factors are taken into account:
- use of the goods during the journey or at the destination;
- seasonality, purpose of the trip and type of transport;
- signs of wear and tear - scratches, dents and other mechanical damage, washing;
- absence of tags, labels, markings and original packaging.
Remember: when importing goods from the EAEU, pay attention not only to their value but also to the quantity of certain types of goods. If the established criterion is exceeded, the import is considered to be carried out for business purposes.
